Attorney Meredith A. Chaiken graduated from Emory University with a Bachelor’s degree in English and graduated cum laude from Nova Southeastern Shepard Broad Law Center. Ms. Chaiken has practiced throughout the State of Florida in federal, state and administrative courts and specializes in defending small businesses. Meredith’s focus on small business stems from childhood, watching her father work seven days per week in the family’s business and struggle at times to keep the machine going. Now, as a business and litigation attorney, Meredith fiercely defends small corporations, including those that are taken advantage of by predatory lenders such as Merchant Cash Advances (MCA).

 

With her father in mind, Meredith’s MCA defense entails disarming the predatory lender, taking the offense and focusing on aggressive litigation. When there is a default judgment, Meredith leverages motion practice to reverse unfavorable rulings and offer businesses a chance to present their cases to the court on an even playing field.  If the MCA funder misrepresented the terms of the cash advance, engaged in deceptive practices or committed outright fraud in their dealings, Meredith contemplates going on the offense for the business owner and taking legal action against the lender. 


When negotiations fail, Meredith has in her arsenal many years of litigation practice to defend businesses against MCA debt claims and UCC liens. She has extensive experience practicing in Federal Court and previously interned with a Federal Court Magistrate Judge. Her litigation experience includes disputes pertaining to labor and employment, government, civil rights, trademark, insurance defense and worker’s compensation defense. Litigating these complex matters makes Meredith well-equipped to navigate the intricacies of MCA defense. Additionally, she has litigated matters for numerous governmental agencies and officials, including state, county and local. Ms. Chaiken also has knowledge of the workings of government and legislation as she previously served as a City Commissioner in Broward County, Florida and was an alternate member of the Broward County Florida Metropolitan Planning Organization.


Ms. Chaiken’s litigation prowess is evident in her strategic approach, combining legal acumen with a thorough understanding of financial intricacies to mount a formidable defense in court.  From crafting pre-trial motions to advocating in the courtroom, Meredith is dedicated to standing up to the big guys and securing favorable outcomes for her clients.  In doing so, Meredith helps her clients avoid bankruptcy and get back on their feet.


In the challenging world of commercial finance litigation, Meredith stands as the advocate businesses need to navigate the complexities of MCA agreements, business debt disputes, UCC lien challenges and default judgments. In addition to MCA Defense, Meredith practices in complex commercial litigation, civil appellate practice and marital/family law. She also serves as in-house litigation and appellate counsel for some of her corporate clients.

Ms. Chaiken is a member of the National Order of Barristers and the Alumni Interview Program for Emory University. She is admitted to practice law in the courts for the State of Florida, as well as in Federal Court including the United States Federal Courts for the Southern and Middle Districts and the United States Court of Appeals for the Eleventh Circuit.


LAW SCHOOL HONORS

In law school Ms. Chaiken was the Chief Justice of the Moot Court Honor Society and participated in Moot Court competitions throughout the United States. She won Best Written Brief and Runner Up Oralist in the E. Earle Zehmer National Moot Court Competition in the area of Workers’ Compensation. Additionally, Ms. Chaiken was awarded the CALI Excellence for the Future Award for earning the highest grade in Trial Advocacy and graduated cum laude.
